What is a Gift Deed?

A Gift Deed is a legal document that records the voluntary transfer of property or assets from one person (the donor) to another (the donee) without any exchange of money, out of natural love and affection.

What assets can I gift?

Both movable assets (cash, jewellery, vehicles, shares) and immovable assets (land, house, flat) can be gifted through a gift deed.

Is registration mandatory?

For immovable property, registration at the sub-registrar's office is mandatory, with both parties and two witnesses present. Movable property gifts are generally valid once executed and notarised.

Can a Gift Deed be revoked?

Once validly executed and accepted by the donee, a Gift Deed is generally irrevocable except in specific circumstances agreed upon in the deed itself or as permitted by law.

Is the gift taxable?

Gifts received from specified relatives are exempt from tax regardless of value. Gifts from non-relatives are exempt only if the total value in a financial year does not exceed ₹50,000.

How is stamp duty calculated?

Stamp duty varies by state and is usually a percentage of the property's market value, often with concessional rates for gifts between close relatives (e.g. parent-child, spouse).
