FAQ

Common Questions

What is a trademark?

A trademark is a unique sign — a name, logo, slogan, or symbol — that distinguishes your goods or services from those of others and legally identifies them as belonging to your brand.

How long does trademark registration take in India?

The Trademark Registry typically issues an examination report within a few weeks of filing. If there's no objection or opposition, registration is usually completed in 8-18 months, though you can start using the ™ symbol immediately after filing.

What's the difference between ™ and ®?

You can use ™ as soon as you file your application to signal a claimed trademark. The ® symbol can only be used once the Registrar has formally granted registration and issued a certificate.

How long is a registered trademark valid?

A trademark registration is valid for 10 years from the filing date, and can be renewed indefinitely for further 10-year periods.

Do I need a registered company to apply?

No. Individuals, sole proprietors, partnership firms, LLPs, private limited companies, and trusts can all apply for trademark registration.

What is a trademark class?

Trademark classes group goods and services into 45 categories under the NICE Classification. You need to file under every class relevant to your business — our team helps identify the right ones during your application.

What happens if my application is objected to or opposed?

An objection from the Examiner or an opposition from a third party doesn't mean rejection — our team prepares and files the appropriate written response or represents you at the hearing to resolve it.

Can I trademark a name that's similar to an existing one?

Only if it's not likely to cause confusion with an existing registered or pending mark in the same class. Our team flags this risk during review before filing.
